Case: Akintola Vs Akintola

The Court of Appeal upheld transfer of the former matrimonial home held as a joint tenancyto the wife's sole name, notwithstanding the wife's litigation misconduct and the fact that she, unlike the husband, had a statutory right to be rehoused as the primary carer of the child of the marriage. In cases such as this it was vital that the parties at first steps should be to contact the local housing authority and explain the need for two smaller, separate units. Such actions would prevent unnecessary litigation at prolonged public expense.
