Clinical Negligence case where the Claimant suffered serious bladder injury as a result of the Defendant’s failure to catheterise her after childbirth. Extensive loss of future earnings and care claim. Numerous issues raised in relation to causation and the acceptance of Part 36 offers.
Alan Dudley & Others -v- Dartford and Gravesham NHS Trust (2006)
This case revolved around a failure by the Trust to diagnose a heat condition which resulted in death. A claim was put forward on behalf of the deceased’s wife, children and Estate. The case was eventually successful but it was extremely difficult in terms of valuing the case due to evidential difficulties on how to prove the deceased’s losses. The case was eventually settled for a significant sum.
Trevor Roberts -v- Bovis Homes Ltd (2006)
This was a claim brought by the Claimant, a sub contracting bricklayer, against the Defendant, a national house building construction company, who were the main contractors and developers of a residential development in West Sussex.
