The Claims Process

INITIAL STAGES

YOU SUFFER AN INJURY

 

You pursue the complaints procedure which we can assist you with and you receive an unsatisfactory response

You come to McMillan Williams for an initial interview

We apply for your medical records, which must be provided within 40 days

Investigations into your claim are carried out. Experts are instructed

Breach of duty liability and causation are established

arrow

Letter of Claim is sent to the Defendant

arrow

Letter of Response is provided to McMillan Williams from the Defendant

arrow

Further investigations are carried out

arrow

Proceedings at Court are issued by way of a Claim form This must be within 3 years of the injury

arrow

The claimants pleadings (particulars of claim, schedule of special damages and medical report) are served on the Defendant

arrow

The Defendant provides a Defence or an Admittance

arrow

Directions (Timetable) is set by the Court
