Whilst obtaining a divorce is a simple procedure, the problems often start when attempting to divide the family assets. The term Ancillary Relief covers the financial provisions that can be made following divorce including maintenance orders, lump sum payments, transfer of property and orders in relation to pension interests.

In cases it is possible to achieve a ‘clean break’ where each party is able to walk away with their own assets and sever all financial ties.  This is encouraged where possible.  When young children are involved it is often harder to achieve a clean break as the non resident parent will be liable to pay child maintenance in respect of the children.

If a financial settlement can be reached without the court's intervention based on the voluntary disclosure of each party; this will have a benefit both in relation to avoiding unnecessary legal costs and achieving a settlement much sooner than if pursued through the court.
