Financial Orders following Divorce

The Court will consider a number of options before making any financial orders after a divorce.

The Court will consider the following before making any order:

  1. the welfare of any children of the family
  2. the financial resources of both parties
  3. the financial needs of both parties
  4. the standard of living of each party
  5. the age of each party and the duration of the marriage
  6. any contributions made by either party to the welfare of the family
  7. the conduct of both parties
  8. whether either party is under a mental disability

 

The Court will consider what is best for both parties. That may mean that they advise a clean break order or alternatively the Court may order periodical payments.
