Contentious Probate

The Litigation Department based at our Streatham office work closely with the Wills and Probate/ Private and Elderly client teams at Carshalton and South Croydon on cases where disputes arise.

These include

- Challenges to wills based on formal defects, undue influence or lack of mental capacity.

- Contested probate: disputes over the distribution of the estate or property within the estate.

-Inheritance Act claims: if you missed out under a will you may yet have a claim to part of the estate.

- Trust disputes: advice to trustees or challenges to their actions.

- Court of Protection cases: the elderly and incapable may need their assets protecting and inappropriate transactions overturning in court.
