Commercial Property Litigation

Our Construction & Commercial Property Litigation Team (part of the Litigation Department) provides specialist litigation and advisory services to commercial and private clients. A well-drafted written contract will reduce a business's exposure to unnecessary disputes. Our advisory services include contract drafting, amendment and negotiation.

In most cases, disputes can and should be dealt with without recourse to litigation. We have experience in the handling of a wide range of contentious construction and commercial property law matters. We carry out a costs/benefits analysis of a dispute as early as possible to arrive at a clear assessment of the best practical outcome. All ways of resolving the dispute are considered including Alternative Dispute Resolution (ADR) or mediation. We then advise you of the most appropriate course of action available to you.

Our specialist property litigation team advises clients on disputes relating to ownership or occupation of commercial property.
These include:

  • Rent and service charge recovery
  • Rent reviews
  • Renewals of business leases under Part II Landlord and Tenant Act 1954
  • Enforcement of lease covenants
  • Tenant default
  • Forfeiture action
  • Possession proceedings
  • Repairs and dilapidations

Our specialist team will assist you in finding the best solution whether through negotiation, mediation, arbitration, adjudication or Court action.

Our aim is to find the best business solution for our commercial clients using the quickest and most cost effective route and applying the highest professional standards.

We consider ourselves not simply litigators, but rather versatile problem solvers. We naturally work closely with other members and specialists in the firm's commercial and residential property team. We can also call on other specialisms available in the firm.

Whenever appropriate, we liase with the client's other professional advisers (such as architects, surveyors and accountants) to form a multi-disciplinary team.

Regardless of the type of transaction, the success of the practice throughout this period has been due to our active policy of client care. This has led to our many satisfied and loyal clients recommending us to their friends and business associates.
