Probate and Trusts

Whether you are an Executor or a family relation we can provide you with as much help as you feel is necessary when dealing with the Administrations of someone’s Estate.
We can provide you with advice on;

  • Determining the size of the Estate for Probate and Inheritance tax purposes
  • Applying for Grant of Representation
  • Settling debts of the Estate
  • Collecting monies due to the Estate.

We can also assist you should any contentious issues arise either by someone making a challenge or if you are someone who wishes to make a challenge concerning the validity of a Will or you are claiming that you should be entitled to a financial provision under the Will.

We are able to advise on the setting up of trusts and trust law in general. A Trust can be set up at any time during your lifetime and can become effective immediately or upon your death.

A Trust is a tax efficient way of passing money and assets for the benefit of a specific individual(s). To find out if the setting up of a trust fund could be beneficial to you or a family member contact us today.

It is possible to rearrange an Estate after someone’s death, for example, to provide for family members who are entitled to make a claim under the Will or possible to settle a claim against the Estate.

Contentious Probate

The Litigation Department based at our Streatham office work closely with the Wills and Probate/ Private and Elderly client teams at Carshalton and South Croydon on cases where disputes arise. These include

  • Challenges to wills based on formal defects, undue influence or lack of mental capacity.
  • Contested probate: disputes over the distribution of the estate or property within the estate.
  • Inheritance Act claims: if you missed out under a will you may yet have a claim to part of the estate.
  • Trust disputes: advice to trustees or challenges to their actions.
  • Court of Protection cases: the elderly and incapable may need their assets protecting and inappropriate transactions overturning in court.
